INEC Under Microscope Of Neutrality

The Independent National Electoral Commission, INEC, has come under screening over its neutrality in administration of elections in the country. Certain legal practitioners have placed the INEC under the microscope of prejudices and biases to ascertain the objectivity or sentiment of the commission, following the recent action deleting the names of African Democratic Congress, ADC, leaders from its Portal.

A renowned legal practitioner, Ebuka Nwaeze Esq, was cited to have stated that the African Democratic Congress, ADC, "only needs to formally notify the Independent National Electoral Commission, INEC, about its planned convention and congresses;." He argued that "the commission’s absence cannot make the process unlawful or invalid..."

Ebuka Nwaeze was cited to have stated that the "Electoral Act expressly prohibits any court from granting an injunction that restrains a political party’s internal election processes".

According to him, “No court can stop a party from producing its executive committee or candidates because that would amount to using the court to prevent a party from participating in an election.”

Nwaeze had maintained that "once a party issues the required invitation to INEC, whether the commission attends or not has no effect on the validity of the outcome".

the legal practitioner assertred that only a final Supreme Court interpretation can ultimately determine the fate of any executive produced.

Somde lawyers, including Femi falana SAN, have also pointed out that the INEC misintepreted the judgement of the Court of Appeal. Invariably, the Commission, relying on its misintepretation, as the lawyers said, may have acted out of contest against the ADC leadership, inclduing stance on the party's national convention.
